Terms of Service

1. Agreement
These Terms of Service (“Terms”) are a contract between you and TomaFreight, operator of TomaDash at https://tomadash.com. By visiting the site, starting as a guest, creating an account, signing in with Google, subscribing, or using Toma-Everywhere, you agree to these Terms and to the Privacy Policy.
If you do not agree, do not use TomaDash.
2. Who may use it
You must be at least 18 and able to form a contract. TomaDash is a business tool for dispatching and carrier outreach. You must provide accurate account information and keep your password (or Google login) under your control.
3. The service
TomaDash is all-in-one dispatching software: find carriers (USDOT / MC), import lists, prospect, sequence dials, track opportunities, trials, and customers, store notes and documents, paste DAT load searches, keep broker/load notes, optionally connect CloudTalk, and (on Pro) talk to Tomaboy. Marketing line: lead generation is built in. Marketplace is a public store for tools, training, hiring, and people open to work — not a dash tab, and not a shared pipeline; see section 11.
It is not a shared company CRM or a shared inbox. Each person keeps their own pipeline. Teams adds seats and roles for a team; it does not merge pipelines. Leaderboard shows activity counts to the team owner — dials, imports, pipeline, and time in the app measured from your open workspace tab — not another member’s files.
Community and Marketplace. Community is a public room where dispatchers ask questions, get support, share feedback, and talk to the people building TomaDash. Marketplace is where people buy and sell tools, training, and work — see section 11. Anyone can read. You need an account to post. Do not publish another account’s carrier list, passwords, or private rates. Buying and selling is between you and the other person — TomaDash is not the merchant and does not hold the money. We may remove posts or listings that break these Terms.
Tomaboy. Tomaboy is an optional Pro assistant. He answers from product notes, a growing knowledge base, and — when the fact has to be current — a live web search that may also read a result page and go back out to a primary source. He can be wrong. Confirm rates, compliance, and contracts yourself. A walkthrough highlights controls in the app; it does not change your pipeline unless you click. Your approximate location is used so he speaks as a dispatcher in your area.
Facts Tomaboy reads on public pages are filed in a shared knowledge base with their source and date, so the next person asking gets the answer faster. Your questions, your chats, and your pipeline are not part of that store. A filed fact can go stale between the day it was read and the day it is quoted, which is why the reply shows you the source and the date.
We do not control the pages Tomaboy reads and do not warrant that anything they say is accurate, current, or complete. Nothing Tomaboy says is legal, tax, insurance, or compliance advice. Treat a live answer as a starting point and check the source before you price a load, sign a contract, or rely on a rule.
Automations. On Pro and Teams you can build an automation that emails a slice of your own pipeline on a schedule through the mailbox you connected. It only mails carriers already on your pipeline, it respects the cooldown you set, and you can turn it off or delete it at any time. You remain the sender of every message it sends — see section 7.
Do-not-contact and preferences. You can mark a file do-not-call or do-not-email. Automations skip do-not-email. Recipients can change those choices at /preferences. Honouring an opt-out is your job as the sender.
AI drafts. When configured, the app can send a short prompt to OpenAI to draft an email template, a Marketplace listing, or broker inquiries after a DAT paste. You are responsible for what you send or publish after you edit it. Broker emails send from your connected inbox only after you tap Send.
Features may change. We may add, change, or remove functions (including Pro-only early access) without notice, except that we will not turn Free into a locked product just to force a subscribe — Free stays usable as described in the product.
4. Accounts, guests, and Google
Guests. “Get started” creates a cookie session and a guest pipeline. That pipeline is not a backup. If you clear cookies, switch browsers, or lose the device, guest work may be gone. Create an account on the same session if you want to keep it.
Email and password. Password must be at least 6 characters. We email a short verification code; the account is not treated as verified until that code matches. Duplicate emails cannot sign up again — log in instead. Signing up from a guest session converts that same pipeline. Logging into a different existing account does not merge a guest pipeline into it.
Google. Sign in with Google uses Google’s OAuth. Google-only accounts have no password until you set one through another flow we may add. If an email already has a password account, Google can be linked to it. You must have a verified Google email.
You are responsible for activity under your session. Log out on shared computers. We may refuse or close accounts that look abusive, automated, or unsafe.
5. Your pipeline and uploads
You keep ownership of content you put in TomaDash (notes, lists you imported, documents, an account photo). You grant us a limited license to host, back up, and display that content solely to provide the service to you. We access what is inside your pipeline only to run the service, to answer a support request you raised, or where security or the law requires it.
If you restore a pipeline from a backup file, pull carrier rows from a JSON feed, or POST to an ingest endpoint, you are asserting that you have the right to hold those contacts. A restore replaces the pipeline on that account, so keep your own copy of anything you cannot lose.
Documents on a customer file (authority letter, W-9, insurance, permits) may include sensitive business information. Do not upload data you have no right to store. Maximum 10 MB per file. We may refuse or remove files that look malicious or illegal.
The product is designed so an empty overwrite cannot silently wipe a live pipeline. There is no in-app “reset account” button. To delete an account, email support@tomafreight.com.
6. Carrier lookup and public data
Import Leads uses DotLookup and public FMCSA / SAFER data. Those sources can be wrong, incomplete, rate limited, or down. You must confirm authority, insurance, and contact details before you rely on them for dispatching.
You will not use TomaDash to scrape in a way that violates DotLookup, FMCSA, or other provider terms, or to build a competing data product from our lookups.
TomaDash does not import Google Sheets. Point Advanced import at JSON you are allowed to use.
7. Calls, email, and outreach
You are solely responsible for calls and messages to carriers: consent, TCPA, DNC, recording laws, and any dispatching contracts. TomaDash may copy a number or open CloudTalk / tel:. The default email template is a TomaFreight dispatching pitch, not TomaDash software pricing.
Email you send through us. If you connect a mailbox (Hostinger, Gmail, or Outlook), TomaDash sends on your behalf from that address. We are the tool; you are the sender. Every message — one-off, sequence, or automation — is your message, from your mailbox, to recipients you chose. That means you are responsible for complying with CAN-SPAM, CASL, the UK and EU e-privacy and data protection rules, and any other law that applies where your recipients are.
In practice, when you email carriers through TomaDash you agree that:
- The from name, from address, and subject line are accurate and not deceptive.
- You have a lawful basis to contact each address, and you did not buy, rent, or harvest the list from somewhere you had no right to take it.
- Your message gives the recipient a clear way to opt out (including a preference-center link to /preferences), and you honour an opt-out promptly across every automation and sequence — mark the file do-not-email or do-not-call, or remove them from the send list.
- You include a real postal or business identity where the law requires one.
- You do not use a connected mailbox to send bulk mail unrelated to your dispatching business.
We may rate-limit, pause, or disconnect a mailbox that generates spam complaints, bounces heavily, or trips a provider’s abuse limits, with or without notice, to protect the service and other customers. Your mailbox provider can suspend you independently of us, on its own terms.
Do not use TomaDash for spam, harassment, or unlawful robocalling.
8. Integrations and APIs
CloudTalk, a connected Hostinger / Gmail / Outlook mailbox, Stripe, Google, DAT One (paste), ingest URLs, and the OpenAI and web-search calls behind Tomaboy are optional or third-party. Their terms apply. Webhooks (https://tomadash.com/api/cloudtalk/webhook, Stripe, lead ingest) must only be used with credentials you control. Unauthenticated ingest is rejected, and the automation runner endpoint refuses any request without the operator’s secret.
Mailbox credentials you paste stay yours. We store them encrypted, use them only to send what you trigger, and delete them when you disconnect. After a Hostinger send we may APPEND a copy to IMAP Sent; we do not read the inbox. Use a mailbox you are allowed to send from, and expect your provider’s own sending limits to apply.
You may POST lead JSON to our ingest endpoints only for your own signed-in account. Do not probe, flood, or impersonate another account.
9. Plans and billing
Free is the default. You can keep using TomaDash without paying. We may show a soft banner (for example after several active days or heavy importing) offering Pro. Later dismisses it for that visit. We do not lock Import, lists, or files behind that banner.
Pro is an optional $9.99/month or $95.90/year upgrade billed by Stripe for unlimited usage positioning, Tomaboy, automations, custom email templates, and early access to newer features. Checkout sets Pro only after Stripe confirms payment (webhook or return to Settings with a paid session). Guests cannot subscribe until they create an account.
Teams is an optional $7.99/user/month plan billed by Stripe after a 14 day trial. It is not individual Pro. Creating a team requires an explicit confirm. Domain auto join uses a verified work domain; public inboxes invite by a 7 day link. Each member keeps their own pipeline. The owner manages billing in Team → Billing (Stripe portal).
Cancel in Stripe via Manage billing. When a subscription ends, plan returns to Free unless we have marked that pipeline grandfathered. Taxes, failed cards, and refunds are handled by Stripe’s flow and our written reply if you email support@tomafreight.com. Fees are in US dollars unless Stripe shows otherwise.
10. Toma-Everywhere
Partner links send people into TomaDash and attribute the visit. The partner dashboard shows referred names and high-level usage (signed in, regular use, last used, Free vs Pro). It is not a sale of those users’ pipelines. We may change or end the program. Partners must not spam, buy fake traffic, or misrepresent TomaDash.
11. Marketplace
Marketplace is a public board where dispatchers list tools, training, services, hiring, and availability. TomaDash is not a party to whatever you agree with the other side, and we are not the payment processor. Money moves directly between buyer and seller by whatever method the listing names. We do not hold funds, we do not escrow, and we do not take a cut of your deal.
If you list. Everything on a listing is public, including the contact email, links, price, seller profile, and photos. Describe what you actually sell at the price you will honour. You must own or have the right to publish every image and every company name you reference, and you must not imply an endorsement you do not have. Pause or delete your ad from My ads at any time.
If you buy. Do your own checking before you pay a stranger. A rating on a listing is other dispatchers’ opinion, not our verification. Disputes about delivery, quality, or refunds are between you and the seller, though you can report a listing to support@tomafreight.com.
Reviews. A review is only accepted from a buyer the seller has confirmed, and it shows under your display name. Write your own honest experience. Do not trade, buy, or incentivise reviews, review your own listing, or post a review to punish someone over something the deal was not about. We may remove a review or a listing that breaks this, and we may remove a listing that is illegal, deceptive, or unsafe.
12. Acceptable use
You will not:
- Break the law, including US trucking, privacy, and anti-spam rules.
- Attack, scrape, or overload TomaDash beyond normal product use.
- Bypass login, share one paid login as a public service, or resell the app without our written okay.
- Upload malware, or data you do not have rights to.
- Impersonate us or another dispatcher.
- Use the demo, health, or webhook endpoints to disrupt the service.
- Point an automation or a connected mailbox at a list you did not build yourself, or keep mailing someone after they asked you to stop.
- Use Tomaboy, an AI-drafted email template, or an AI-drafted Marketplace listing to generate messages you then send in breach of section 7.
- Post Marketplace listings you do not have the right to sell, impersonate another seller, or use the Marketplace inbox to spam or harass.
13. Our intellectual property
TomaDash, the site design, and our code and trademarks stay ours. You may not copy the product, reverse engineer it except where the law allows, or use our name in a way that suggests we endorse your dispatching shop, except fair factual use (“we use TomaDash”).
Feedback you send (including integration requests) may be used to improve TomaDash without paying you.
14. Availability
We host on Render and similar providers. Instances can sleep, restart, or fail. Lookups and mail can fail. We do not promise uninterrupted service or that every FMCSA / DotLookup / CloudTalk sync will succeed. If the app is idle, a first open may be slow — reload.
15. Disclaimer
TomaDash is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. We do not warrant that carrier data is current, that a load will pipeline, that every automation run or email will be delivered, that anything Tomaboy reads on the web is accurate, or that Pro features will ship on a given date.
16. Limitation of liability
To the fullest extent allowed by law, TomaFreight and its people will not be liable for lost profits, lost loads, lost data (including guest pipelines), replacement dispatching software, or indirect, incidental, special, or consequential damages.
Our total liability for any claim relating to TomaDash is limited to the greater of (a) amounts you paid us for Pro in the three months before the claim or (b) twenty-five US dollars ($25), except where the law forbids that cap.
17. Indemnity
You will defend and indemnify us against claims that arise from your pipeline, your calls and emails (including anything an automation sends from your connected mailbox), your documents, your use of carrier data, or your breach of these Terms.
18. Suspension and ending
You may stop using TomaDash at any time and cancel Pro in Stripe. We may suspend or close access if you break these Terms, if required by law, or if we shut the product down. Sections that should survive (including 5, 13–17, 19) survive.
19. Law and disputes
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules. Courts with jurisdiction over TomaFreight’s principal place of business may hear disputes, unless a law that cannot be waived requires otherwise. You and we both waive class actions to the extent the law allows.
20. Miscellaneous
These Terms and the Privacy Policy are the whole agreement for TomaDash. If a part is unenforceable, the rest stays. We may update these Terms; the effective date will change. Continued use is acceptance. You may not assign your account without our okay; we may assign the contract in a sale of the business. No waiver is implied by delay.
